Sam C. Toma

Sam C. Toma is a named partner with Devlin, Cittadino & Toma, P.C., where he represents injured workers and individuals throughout New Jersey. His practice focuses heavily on New Jersey workers’ compensation, and over more than 15 years of practice, he has handled virtually every type of workers’ compensation matter, from straightforward workplace injuries to complex and heavily contested claims involving significant medical treatment, multiple surgeries, permanent disability, and disputed causation.

Sam’s approach to workers’ compensation is grounded in two priorities: understanding the full scope and value of a client’s claim, and making sure the client understands what is happening at every stage of the process. He takes the time to listen carefully to his clients, understand not only how an injury occurred but how it has affected their work and daily lives, and identify the issues that can make a meaningful difference in the outcome of a claim. He believes that maximizing the value of a workers’ compensation claim requires more than simply evaluating an injury; it requires understanding the medical evidence, the client’s history, the applicable law, and how those pieces fit together.

Over the course of his career, Sam has represented injured workers in virtually every type of New Jersey workers’ compensation dispute, including claims involving the compensability of an injury, temporary disability benefits, medical treatment, diagnostic testing and surgery, permanency, occupational claims, aggravation of pre-existing conditions, and complex questions of medical and factual causation. He represents clients throughout the litigation process, including claim petitions, motions for temporary and medical benefits, settlement negotiations, and trials before the New Jersey Division of Workers’ Compensation.

Sam approaches each claim with the goal of identifying every legitimate source of value available to the client, while remaining realistic about the strengths and limitations of the evidence.

A significant part of Sam’s practice involves helping clients navigate situations that are often confusing and intimidating. He believes clients should understand not only what their lawyer recommends, but why. Whether explaining the workers’ compensation process, evaluating medical evidence, discussing the potential value of a claim, or preparing a client for testimony, Sam makes a point of explaining complicated legal and medical issues in straightforward terms. His goal is for clients to feel informed and prepared, rather than simply handed instructions about what to do next.

Sam earned his law degree from Rutgers School of Law–Camden and his undergraduate degree from Lafayette College. He is admitted to practice in New Jersey and is a member of the Mercer County Bar Association, the New Jersey State Bar Association, and the New Jersey Council on Safety & Health.
