What is the impact of a failure to diagnose on victims?

A failure to diagnose can be devastating to victims and even fatal in some instances. Because of this, victims who have trusted their medical care provider and had that trust violated because of medical malpractice should be familiar with the legal remedies available to them.

The impact of failure to diagnose

There are several different ways that a diagnosis can go wrong and if the medical care the victim receives falls below the standard of care, and they are harmed, they may have a claim for damages.

  • Erroneous diagnosis: An erroneous diagnosis can result in the victim not receiving the medical care and treatment they need. They may also receive the wrong medical care and treatment which may harm them further in some circumstances.
  • Delayed diagnosis: A delayed diagnosis refers to when the victim is not timely diagnosed. They delay can result in them not receiving the medical care and treatment they need when they need it.
  • Failure to diagnose: A failure to diagnose occurs when the victim is not diagnosed at all. This can, of course, result in a worsened medical condition and may be fatal in some circumstances.

It is problematic for patients to not be diagnosed timely, to receive the wrong diagnosis or to not be diagnosed at all. When the victim has suffered a worsened medical condition because of misdiagnosis, delayed diagnosis or a failure to diagnose, they may be able to bring a personal injury claim for damages against the negligent medical care provider responsible for the harm they suffered which is why victims should be familiar with the legal protections available.
